Terms of Use (EULA).

These Terms of Use ("Terms") govern your access to and use of the TourismIntel website (tourismintel.ai), the TourismIntel iOS and Android mobile applications, and the related services (collectively, the "Service"), operated by Mirko Lalli ("we", "us", "TourismIntel"), with registered address at Via del Tiratoio 1, 50124 Firenze, Italy.

By creating an account, downloading the mobile app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acknowledgement

You acknowledge that these Terms are concluded between you and TourismIntel, and not with Apple Inc. ("Apple"). TourismIntel — not Apple — is solely responsible for the TourismIntel mobile application and the content thereof. These Terms do not provide usage rules for the application that are less restrictive than, or in conflict with, the Apple Media Services Terms and Conditions as of the effective date of these Terms.

2. Scope of License

We grant you a non-transferable, non-exclusive, revocable license to use the TourismIntel mobile application on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not distribute or make the application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, sublicense, decompile, reverse engineer, disassemble, or modify the application except where permitted by applicable law.

3. Account

To use the Service, you must create an account by providing a valid email address. We use a passwordless magic link authentication system — you will never set a password. You are responsible for safeguarding access to your email inbox and for all activities under your account. You must be at least 16 years old to create an account.

You may delete your account at any time from within the mobile app (Settings → Account → Delete Account) or by emailing support@tourismintel.ai. Account deletion is permanent and irreversible.

4. Subscriptions and In-App Purchases

The Service offers the following paid plans, available through the iOS App Store:

Founder Lifetime terms

The PRO Founder Lifetime plan is a one-time purchase (non-consumable). It grants access to PRO features for the lifetime of the TourismIntel iOS service. It does not auto-renew and is not subject to refund except where required by applicable law.

5. Consent to Use of Data

By using the Service, you consent to our collection and use of technical data and related information, including but not limited to information about your device, system, application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the Service. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you. 6. Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any term. Upon termination, you must cease all use of the Service. Sections 5 through 12 survive termination.

7. External Services and Content

The Service may enable access to third-party services and websites ("External Services") and may display, include, or make available third-party content (including data, information, applications, and materials). You agree to use the External Services at your sole risk. TourismIntel is not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any such External Services. Data displayed by the Service is for informational purposes only and is not intended for any other use, including financial, medical, or commercial decisions.

8. No Warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND TOURISMINTEL HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

9. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL TOURISMINTEL BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

In no event shall TourismIntel's total liability to you for all damages exceed the amount of fifty euros (€50) or the amount you paid to TourismIntel in the preceding twelve months, whichever is greater.

10. Export Control

You may not use or otherwise export or re-export the Service except as authorised by United States law and the laws of the jurisdiction in which the Service was obtained.

11. Commercial Items

The Service and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation".

12. Third-Party Beneficiary

You and TourismIntel acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Governing Law and Disputes

These Terms are governed by the laws of Italy, without regard to its conflict of laws provisions. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Florence, Italy, except where consumer-protection laws grant you the right to bring proceedings in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance.
